Back in the 70s, 80s, and early 90s this was true. But in the 90s the U.S. Congress extended the copyright
"protection" to 75 years. So there are publications that were "public domain" for a while in the 80s and
90s but then went back under copyright protection. I know that someone is challenging the
constitutionality of this, but the law as it stands gives at least 75 years of copyright protection now.
That means that everything published after 1928 is still under U.S. copyright.
