You may legal grounds for compensation for damages; not being
a lawyer, I don't know what exactally and specifically constitutes
these grounds and how you document or prove you have been
damaged or how much you have been damaged.
Ethecially and morally, there is no question in my mind of this.
Was the spray applied by the home owner or a commercial
firm which he hired.
Is there not a law in (all? most? some?) states that pesticides and
posions
may not be sprayed if the wind is blowing over a given mph? Was that
the case, or was it one of normal vaporation and wind-drift on a
relatively still day.
Even if the latter, it might be a good idea to check state laws
for how, when, and how strong a spray may be applied to
any home property.
When ever I see my neighbor's yard service park in front
of her house, I move to the property line and watch to
take note of how the application goes. He is so cavalier
and unconcerned in how he sprays and argumentative and
defensive if I ask him any questions. Several times I have
been tempted to call the lawn service for whom he is
employee but have not as yet.
I wish there was some item I could place outside that
would register if and how much pattern overspray there
was; this would be the proof positive I need to take action
against his employer. In years past I have seen damage but
missed observing his visits; this year I have so far been
present and that I am sure has caused him to take more care
than he would otherwise.
Its been a long time since I checked about
application liscences and how much training is legally required;
and there are many times I have wondered if he was given
the required training.
And here is one other consideration -- not only your plants
but your body as well has been compromised. If the drift
is that strong, you will have inhaled it and absorbed it
transdermally as it hit your skin.
I wish for you the best in this how ever you can and
choose to proceed.
And as to what you do to remediate damage, possibly the compost tea
applications are the best remedy available. Does any one know of
specific bio-critters that could be brewed to
deal with--complex or degrade -- the particular substances used in the
spray.
