    Title: CA mars 2011 (310e session): 359e rapport du Comité de la liberté syndicale - extraits sur le Myanmar

    Description/subject: "...109. Le comité prend note des informations fournies par le gouvernement. S’agissant de ses recommandations de nature législative, le comité rappelle que depuis un certain nombre d’années il a souligné la nécessité d’élaborer une législation garantissant la liberté syndicale et de s’assurer qu’une autre législation ne serait pas appliquée de façon à affaiblir cette garantie. Il rappelle en outre la carence persistante du gouvernement à prendre quelque mesure que ce soit pour remédier à cette situation législative qui constitue un manquement grave et persistant aux obligations qui incombent au gouvernement du fait qu’il a ratifié volontairement la convention no 87. A la lumière de ces principes, le comité se félicite de l’information fournie par le gouvernement selon laquelle le Parlement prendra les mesures nécessaires concernant l’abrogation des ordonnances nos 2/88 et 6/88, de la loi sur les associations illicites et de la déclaration no 1/2006...113. Le comité prend note des informations fournies par le gouvernement et, en particulier, une fois de plus, des informations concernant son intention d’élaborer une nouvelle législation conforme à la convention no 87. Toutefois, le comité regrette profondément encore une fois que le gouvernement se borne essentiellement à reprendre la teneur de ses précédentes communications sans fournir de nouvelles informations concrètes ni présenter aucune preuve qu’il a pris des mesures concrètes pour résoudre les graves problèmes soulevés par le présent cas. Il déplore donc que le gouvernement n’ait pas mis en oeuvre ses recommandations et il se trouve obligé de renvoyer à son précédent examen de ce cas. Il demande instamment et fermement au gouvernement de mettre de toute urgence pleinement en oeuvre ses recommandations précédentes. Le comité prie le gouvernement, en particulier, de fournir des informations précises et détaillées sur la situation de Thurein Aung, Wai Lin, Nyi Nyi Zaw, Kyaw Kyaw, Kyaw Win et Myo Min. Il l’invite à prendre toutes les mesures nécessaires pour assurer leur libération immédiate ainsi que leur accès à une aide juridique et médicale pendant leur détention. Enfin, le comité prie instamment le gouvernement de prendre immédiatement des mesures effectives et concrètes pour assurer le plein respect de la liberté syndicale en droit et en pratique."

Le Conseil d’administration a décidé: a) que le Directeur général devrait inviter le gouvernement du Myanmar à lui communiquer ses observations en la matière afin qu’elles lui parviennent au plus tard le 31 janvier 2011; b) que le gouvernement du Myanmar devrait être invité à envoyer un représentant pour participer aux travaux du Conseil d’administration concernant cette affaire lors de ses prochaines sessions, conformément à l’article 26, paragraphe 5, de la Constitution de l’OIT; lorsqu’il enverra cette invitation au gouvernement du Myanmar, le Directeur général devrait l’informer que le Conseil d’administration a l’intention de poursuivre sa discussion de ce cas lors de sa 310e session, qui aurait lieu à Genève en mars 2011; c) que la décision sur la question de savoir si la plainte dans son ensemble devrait être renvoyée à une commission d’enquête, conformément à l’article 26, paragraphe 4, de la Constitution de l’OIT, serait renvoyée à une étape ultérieure, à la lumière des informations fournies au Conseil d’administration concernant cette plainte.

En lo que se refiere a sus recomendaciones de carácter legislativo, el Comité recuerda que desde hace varios años subraya la necesidad de elaborar una legislación que garantice el ejercicio de la libertad sindical, así como de velar por que no se aplique la legislación vigente que impide ejercer ese derecho. Asimismo, recuerda que el constante incumplimiento del deber de adoptar medidas con el fin de subsanar las deficiencias legislativas constituye una grave y persistente violación de las obligaciones que para el Gobierno se derivan de su ratificación voluntaria del Convenio núm. 87. A la luz de estos principios, el Comité toma nota con agrado de la información proporcionada por el Gobierno según la cual el Parlamento adoptará las medidas necesarias en relación con la derogación de las órdenes núms. 2/88 y 6/88, la Ley sobre las Asociaciones Ilícitas y la declaración núm. 1/2006...113. El Comité toma nota de la información presentada por el Gobierno y, en particular, de la reiteración de su intención de elaborar nuevas leyes en consonancia con el Convenio núm. 87. No obstante, el Comité lamenta profundamente una vez más que en la comunicación del Gobierno se repita en lo esencial la información previamente facilitada y que no se presente ninguna información o evidencia específica de que el Gobierno haya tomado medidas concretas respecto de las graves cuestiones abordadas en este caso. Por consiguiente, el Comité deplora que el Gobierno no haya puesto en práctica sus recomendaciones y se ve en la obligación de remitirse al examen que hizo anteriormente de este caso y a urgir firmemente al Gobierno a que, con carácter urgente, aplique plenamente las recomendaciones previas del Comité. En particular, el Comité pide al Gobierno que presente información específica y detallada acerca de la situación de Thurein Aung, Wai Lin, Nyi Nyi Zaw, Kyaw Kyaw, Kyaw Win y Myo Min. In light of these principles, the Committee welcomes the information provided by the Government that the Parliament will take the necessary measures regarding the repealing of Orders Nos 2/88, 6/88, the Unlawful Association Act and Declaration No. 1/2006...113. The Committee takes note of the information provided by the Government and in particular, once again, the information concerning its intention to draft new legislation in conformity with Convention No. 87. The Committee, however, once again deeply regrets that the Government‟s communications essentially repeat those previously submitted, while failing to provide any new concrete information or present any evidence that it has taken concrete measures in respect of the serious matters presented in this case. It therefore deplores that the Government has failed to implement its recommendations and finds itself obliged to refer to its previous examination of this case and to firmly urge the Government to fully implement as a matter of urgency its previous recommendations. The Committee requests the Government, in particular, to provide specific and detailed information on the situation of Thurein Aung, Wai Lin, Nyi Nyi Zaw, Kyaw Kyaw, Kyaw Win and Myo Min. It requests the Government to take all the necessary measures to ensure their immediate release, as well as their access to legal and medical assistance while detained. Finally, the Committee urges the Government to immediately undertake real and concrete steps to ensure full respect for freedom of association in law and in practice..."

It is too early to make a definitive pronouncement on the mechanism, given the various questions which have been underlined by the developments recorded by the Liaison Officer and the discussions that the ILO mission held in Nay Pyi Taw and Yangon from 25 to 28 February 2008. Concrete measures are expected on the follow-up of specific cases, on translations and distribution of information material, educational activities and the ways to reach better the population in the country. 29. Forced labour in Myanmar continues to be a serious problem. While a mechanism such as the one introduced by the Supplementary Understanding will not be able on its own to have a major impact on the problem, it demonstrates how, given political will and the necessary legal and administrative safeguards, it can make a difference. 30. In this respect, whatever the shortcomings as regards the content and process for the adoption of a new Constitution, it has the potential of providing the authorities with an opportunity to bring legal clarity to the prohibition of forced labour. Although the Government has not yet made a high-level public statement of the kind that the Governing Body has called for in November 2007, following up a possible future constitutional commitment vigorously, genuinely and transparently would be a significant and concrete expression of the commitment of the authorities to abandoning the still prevalent use of forced labour throughout the country."

The long prison sentences given on 7 September 2007 to six activists should be reviewed and the persons concerned released. The Governing Body also noted with concern the detention of persons associated with the facilitation of forced labour complaints under the SU. This clearly contradicted the sense of the SU and the Governing Body called on the Government to immediately release those persons, in particular Daw Su Su Nway and U Min Aung..."

    Description/subject: The ILO Governing Body today reactivated the “measures” contained in the International Labour Conference (ILC) resolution of June 2000. In fact, as the Conclusions of today’s meeting state, the measures have never ceased to be in force. The “reactivation” consisted in affirming that no adequate moves have been taken by the Burmese military regime (the “Government” of Myanmar) to reduce forced labour in Burma/Myanmar, and that there is therefore no reason not to apply the “review of relations” requested in the 2000 resolution. The ILO press release (Document 1, below) helps to clarify the Conclusions, Document 2, and the ILC 2000 resolution (Document 3) sets out the “measures”. Document 4 consists of links to the ILO reports submitted to the March 2005 session of the Governing Body, its Conclusions, and the ILO section of the Online Burma/Myanmar Library.

It examines developments in the high treason case and of the forced labour situation, of which it states: "...On the basis of all the information available to him, the Liaison Officer a.i.’s general evaluation of the forced labour situation continues to be, as presented previously to the Governing Body, 8 that although there have been some improvements since the Commission of Inquiry, the practice remains widespread throughout the country, and is particularly serious in border areas where there is a large presence of the army...".

The Government had communicated the recommendations contained in the Conference resolution to the countrys most representative employers and workers organizations. In talks with the Permanent Representative of Myanmar, Ambassador U Mya Than, shortly after the conclusion of the 88th Session of the International Labour Conference, the Director-General emphasized the need for urgent action on the part of the Myanmar authorities to give effect as quickly as possible to the resolution adopted by the Conference at its 88th Session. He recalled that the resolution in question had authorized the Office to respond positively to all requests by Myanmar for assistance in attaining that goal. On 14 July, the Director-General followed up this conversation with a letter addressed to the Minister of Labour of Myanmar (Annex 1). 2. In an interim reply dated 7 August (Annex 2), the Minister of Labour, while expressing regret that the Conference had not chosen the path of cooperation to resolve the issue, stated that consultations were in progress in Yangon with a view to the adoption of a considered position. 3. On 8 September, the Director-General met the Minister of Foreign Affairs of Myanmar, Mr. Win Aung, at the United Nations Millennium Summit. During the meeting, the Director-General again emphasized the increasing urgency of action on the part of the Myanmar authorities to give effect to the Conference resolution, given that the next session of the Governing Body was only two months away, and recalled that such action was needed in the three main areas indicated in the resolution, namely legislative, executive and administrative measures. In the absence of any concrete action in those areas, the measures adopted by the Conference would take effect. The Minister assured the Director-General..."

The Director-General on Friday, 3 November received a letter from the Minister of Labour which communicated the text of an instruction signed by Lieutenant-General Khin Nyunt in his capacity as Secretary-1 of the SPDC. In addition, in a separate communication addressed to the head of the mission, the Director-General of the Department of Labour specifies the measures adopted to ensure that forced labour is no longer imposed in practice. The following observations may assist the Governing Body in its assessment of the import of these new elements: (i) The chain of command in Myanmar 4. The highest authority in Myanmar is the State Peace and Development Council (SPDC), which includes all military regional commanders and the chiefs of staff of the army, navy and air force, but does not include government ministers. Under the terms of article 33 of the Constitution of the ILO, the International Labour Conference adopted a resolution approving the measures recommended by the Governing Body at its 277th Session (March 2000) to secure compliance with the recommendations of the Commission of Inquiry established to examine the observance by Myanmar of its obligations in respect of the Forced Labour Convention, 1930 (No. 29), and decided that those measures would take effect on 30 November 2000, subject to the conditions set out in paragraph 2 of the resolution. The Conference considered that it could not abstain from the immediate application of the measures recommended by the Governing Body unless the Myanmar authorities promptly take concrete action to adopt the necessary framework for implementing the Commission of Inquirys recommendations, thereby ensuring that the situation [of workers affected by various forms of forced or compulsory labour] will be remedied more expeditiously and under more satisfactory conditions for all concerned. 1 2. The Conference entrusted the Governing Body with the task of examining the legislative, executive and administrative framework which must be sufficiently concrete and detailed to demonstrate that the recommendations of the Commission of Inquiry have been fulfilled and such as to give effect to the intentions expressed by the Minister of Labour of Myanmar in his letter dated 27 May 2000, which followed the first technical cooperation mission sent by the Director-General to Yangon from 23 to 27 May 2000. (ILO Report, para 435). The 1998 ILO Inquiry into forced labour in Burma covers a wide range of human rights violations in addition to forced labour. The Commission of Inquiry, which is the most senior body to have examined human rights in Burma, reported that the Rohingyas suffer a higher level of discrimination than other groups in the country.
