A reader who is a CSPAer reported to us about his parents' application for
B2 visa being rejected by the the US Consulate in Guangzhou recently. The
reader called that Consular later from the US, and got a reply which is
rather disturbing.  According to the reader, he was told that "since you
have GC, I (the Consular) can't give them visa". The reader went asking "are
you saying that for people like my parents they will never get tourist visas
to the US?", and the Consular answered a firm "Yes".

Agricultural University (ABAU), several of us have volunteered to form a
preparatory working team for setting up an Email Network of ABAU. So far we
have had five people from different geographic areas volunteered as contact
persons: Zhiqiang An (Madison, Wisconsin);  Cunshan Wang (Ithaca, New York);
Shenquan Pan (Seattle, Washington); Jinrong Xu (Manhattan, Kansas); Shouhua
Xiao (Baton Rouge, Louisiana); and Fu Gao (Oxford, England).  To join,

coordination.  This move is also intended as the first step for further

   Since the IFCSS 5th Congress in July 1993, there have been questions
   from concerned readers about the financial operations of last term IFCSS
   Headquarters and the IFCSS CSPA Information Center, the amount of money
   involved is about 300,000 dollars.  Based on the materials and information
   released to the public and forwarded to CND-US by IFCSS HQ, IFCSS Council
   and IFCSS activists, an independent correspondent from CND-US wrote the
   following report on the dispute over the financial operation in the IFCSS.]

It's HOW to audit, Stupid!

It's become a fashionable expression for politicians, after "It's the
economy, Stupid!" being cited everywhere by the U.S. media.

However, there is no better expression for the current fierce dispute between
the IFCSS HQ and the IFCSS Council over the financial auditing dilemma on
the IFCSS HQ's financial system.

In a recent News Release (#5085, 12/12/93), the IFCSS HQ notified the public
of their contacting with several offices (names not released) of Certified
Public Accountants (CPA) in Washington D.C. for proposals to enter a bid for
auditing the IFCSS HQ's accounting system.

Being aware of the existence of a financial Inspection Team (IT) launched by
the Financial Committee of IFCSS Council, many people might be puzzled by the
said proposal, let alone the fact that a final internal report has never
been out from the financial IT.

According to a memo forwarded to CND by Jinghong Li, the former IFCSS Council
Chair, shortly before the release of the aforementioned NR, there had been
accusations brought up against the Council. The Council was tagged conducting
"illegal activities". As indicated in the memo, one of such activities was to
have invited a non-IFCSS-official volunteer, who is a Government
Administration major with emphasis on financial management, to join the work
of the IT; the other was the Council's extending the Inspection Team into a
Task Force (TF).

Being curious and concerned as many readers are, the correspondent digged
through some old archives and tried to patch a fair and factual picture for
the whole story.

_From the communication exchanges between the IFCSS HQ and the Council
available to the public, we found that things are really unpleasant.

Dating back to Aug. 14, a resolution on Financial Inspection of HQ was
proposed by the Council Financial Committee (drafted by Zhou Hongguang) at
the 1st session of Council Teleconference. It was then passed at the 2nd
session of the Teleconference on Aug. 21. We learned from some channel that
a failed move of blocking the resolution was tried by the HQ. An Inspection
Team was then formed with Zhou Hongguang as the coordinator, and an agenda
was sent to the HQ.  On Sept. 22, a signed memo from the Council was sent to
the HQ, reiterating the agenda and requesting for the needed accounting
records.

Now here comes the problem. From the memo exchanges, we see a painful
on-going process of asking for and denying of some of the needed financial
records from the respective parties. For example, the IT insists on asking
for the records for the CSPA Information Center account, which brought in a
revenue of more than $200,000, and that for the IFCSS 5th Congress, which had
a budget around $70,000. The HQ furnished a set of Summary Sheets. And the IT
insists on receiving financial reports consisting of "Operation Statement,
Balance Sheet and Cash Flow Statement". It then evolved into a hot rebuttal
between the HQ Treasurer and the IT. Both sides began to teach each other
the ABC's in accounting. "I don't understand how equity could refer to cash
as mentioned in the memo, and what is the meaning of 'tangible and
intangible' equity?"  asked the HQ treasurer in her statement. The site
inspection was conducted at the HQ from Nov 5-7. According to the IT, there
was not a complete accounting record at the HQ at all, "the IT ended up
doing the basic bookkeeping work for the (HQ) treasurer", said a Council
member who prefers to be anonymous for now.

Things didn't stop there. The Council had the 2nd Teleconference on Nov. 20.
According to sources, the meeting exploded to a chaotic debate after Luo
Lishi, an IFCSS SVC member, questioned the qualification of Bai Yan, the
aforementioned volunteer in the IT. However, the Financial committee
concluded that the information made available to the IT was incomplete, and
the Council was not able to make a final say on the IFCSS' financial
situation, thus the IT should continue requesting needed materials and work
on the inprovement of IFCSS' internal financial regulation.

But, HOW?

We have seen it. The Council decided to extend the IT into a Task Force.
The HQ rebuffed it as illegal, while expressing its willingness for an open
bidding of professional auditing. In a News Release from the Council (#5006),
the Council Financial Committee "is pleased" to see the HQ's positive action,
and reiterated "meanwhile, the Finance Committee continues to urge the
Inspection Team on making greater efforts to proceed with its internal
inspection as planned".

So, to audit or not to audit?  Seems it's not a problem--both parties agree
on a firm "Yes". And, it really should NOT be a problem.  Criticisms have
been around for a while about the problems of IFCSS HQ's poor financial
management. And, according to the sources available to the public, thousands
of dollars could have gone unexplained. An IFCSS official was said to have
used IFCSS check to pay his/her personal rent, and some official's spouse,
who worked for the CSPA Information Center, were still paid in August, after
the CSPA Center was closed.

Now, you tell me HOW.

In a recent issue of News Release, the IFCSS HQ has relayed an INS cable
(the CSPA Wire #6) obtained from Mr. E.B.  Duarte, Director of Examinations
Operations Facilitation Program of the INS. This cable is also carried in
the recently published Interpreter Releases No. 70. The cable directs the
local INS offices on the issuance of voluntary departure and/or employment
authorization to certain family members of Chinese Student Protection Act
(CSPA) principals.

Re: Chinese Student Protection Act of 1992 (CSPA). This is CSPA Wire #6.

This wire concerns issuance of voluntary departure and/or employment
authorization to certain family members of Chinese Student Protection Act
(CSPA) principals. This wire should be understood to reference only cases
involving family members whose spousal or child-parent relationship to the
CSPA principal was legally established prior to the date the CSPA principals'
application for CSPA adjustment of status was (is) approved, and who arrived
in the United States before July 1, 1993. This wire should not (repeat not)
be understood as either encouraging or discouraging the issuance of
voluntary departure and employment authorization in other types of cases.

District directors are encouraged to give favorable consideration to
granting voluntary departure without issuance of an order to show cause in
one year increments in response to a request for voluntary departure made by
a spouse or child of a CSPA principal if the spouse or child is ineligible
to immediately apply for adjustment of status and is unable to maintain a
valid immigration status in the United States.

Favorable consideration may be deemed by the district director to be
inappropriate in cases where substantial adverse factors exist, such as the
spouse or child's entry without inspection, his or her conviction for a
crime involving moral turpitude, or if the familial relationship appears to
have been entered into solely for the purpose of obtaining immigration
benefits. Intent to remain permanently in the United States at the time of
admission as a nonimmigrant, lack of an approved immigrant visa petition on
the family members' behalf, or the fact that the CSPA principal's
application for CSPA status has not yet been approved should not be
considered as adverse factors in reviewing these cases.

A family member who has been granted voluntary departure may request
employment authorization pursuant to 8 CFR 274A.12(c)(12).  District
directors are encouraged to give favorable consideration to requests by
family members who establish economic necessity.

Those family members who have been granted voluntary departure and who need
to travel outside the United States for emergent reasons may be issued
advance parole under guidelines set forth in OI 212.5(c).

A BILL

To amend the Immigration and Nationality Act to permit the admission to the
United States of nonimmigrant students and visitors who are the spouses and
children of United States permanent resident aliens, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United
States of America in Congress assembled,

SECTION 1. ADMISSION OF CERTAIN "B" AND "F" VISA NONIMMIGRANTS WHO ARE
SPOUSES OR CHILDREN OF UNITED STATES PERMANENT RESIDENT ALIENS.

Section 212 of the Immigration and Nationality Act (8 U.S.C.  1182) is
amended by adding at the end thereof the following new subsection:

(o)(1) Notwithstanding any other provision of law, no alien---

   (A) who is the spouse or child of an alien lawfully admitted for
permanent residence to the United States,
   (B) who seeks admission to the United States for purposes of visiting the
permanent resident spouse or parent or for studying in the United States, and
   (C) who is otherwise qualified,

may be denied issuance of a visa, or may be denied admission to the United
States, as a nonimmigrant alien described in section 101(a)(15)(B) who is
coming to the United States temporarily for pleasure or as a nonimmigrant
alien described in section 101(a)(15)(F).

   (2) Whenever an alien described in paragraph (1) seeks admission to the
United States as a nonimmigrant alien described in section 101(a)(15)(B) who
is coming temporarily for pleasure or as a nonimmigrant alien described in
section 101(a)(15)(F), the fact that a petition has been filed on the
alien's behalf for classification of the alien as an alien lawfully admitted
for permanent residence shall not constitute evidence of the alien's
intention to abandon his or her foreign residence.

   (3) Notwithstanding any other provision of law, any alien-

   (A) who is issued a nonimmigrant visa under paragraph (1),
   (B) who was admitted to the United States,
and
   (C) who remains in the United States longer than the period authorized
for such nonimmigrant status,

shall be ineligible to receive an immigrant visa for a period of up to one
year after the alien's priority date has been reached, as the Secretary of
State may determine.

First Announcement and Call for Papers

Sponsored and organized by National Science Foundation of China, Co-
Organized by Institute of Systems Science, Academia Sinica, The First
Conference on Management Science for Domestic and Overseas Young Scientists
(CMSDOYS'94) will be held in Beijing, China, July 19-22, 1994.

The basic aim of CMSDOYS'94 is to provide an active exchange of
information on recent advances in Management Science and also to
build a bridge between the domestic young scientists and the
overseas ones.  Some of the topics of particular interest are given
below, but this is by no means an exhaustive list:
    -New theories, new methodologies and new areas in Management Science;
    -Research and developments;
    -Applications of foreign advanced management methodologies, technologies
and experiences to the management practices in China.

A Proceedings Volume in English containing a selection of the full papers
will be published by International Academic Publishers before the
conference.  Authors should submit two copies of a full paper prepared
strictly following the Instructions for Authors.  The maximum length of a
paper is 8 papers including figures, tables, references, appendices, etc.
The selected contributions should clearly show their significance and
originality. Deadline for submission of the camera-ready full paper:
February 15, 1994.  Notification of acceptance of the paper will be given
before March 15, 1994. Participants should be under 45.
