We forward this summary here, hoping it will help you understand the changes and the possible impact on you. The article was written by a Montreal-based attorney Colin R. Singer, and was first posted on the Usenet misc.immigration.canada. Some editing was done on the original article. The Strategic Framework attempts to establish a coherent set of objectives and a plan of action for the immigration and citizenship program. It appears that the Government's goals include: Enriching Canada's Social Fabric According to an addendum to the abovenoted references, this objective will be achieved via the introduction of a new Citizenship Act; an emphasis on the selection of immigrants who are likely to contribute to Canada's economic and social development, reducing demand on integration services; an allocation of resources for the recruitment and promotion of economic immigration; and the movement towards an improvement of efficiency and cost effectiveness of language training and related settlement services. Supporting Economic Growth This objective will be addressed by devising a selection criteria which will place greater emphasis on an immigrant's abilities to adjust to Canada's changing labour market requirements; placing a greater emphasis on a knowledge of one of Canada's Official languages; expediting applications of immigrants who are likely to address specific labour market shortages; a streamlining of the process for the applications of temporary employment authorization visas; expediting applications for permanent residence for independent and business immigrants identified by Provincial requirements; and strengthening the business immigration program. Maintaining Strong Support for the Family This objective will be addressed by continuing with the current policy of prioritizing reunification of the Family Class and specifically spouses and dependent children; introducing a strategy to improve compliance with sponsorship obligations; establishing a separate category of immigration entitled - parents and grandparents. Realizing Canada's Humanitarian Mission This objective pertains to Canada's continuing role as a world leader in addressing the needs of Refugees. Fair Access and the Rule of Law This goal is an enforcement provision which is oriented to address the ongoing abuse and misuse of Canada's immigration laws. What are the projected numbers of immigrants which the Government's Immigration Plan provides for in 1995? The 1995 Plan anticipates that between 190,000 and 215,000 immigrants and refugees will be admitted next year. This includes 86,000-90,000 Family immigrants; 71,000-80,000 Economic Immigrants; 9,000-13,000 "Other" immigrants; and 24,000- 32,000 Refugees. How does the Immigration Plan for 1995 compare with the projections for 1994? It is projected that approximately 230,000 immigrants and refugees will have been admitted into Canada in 1994. This includes 109,000 Family immigrants; 91,000 Economic Immigrants; 12,000 "Other" immigrants; and 18,000 Refugees. What are the Government's intentions regarding the introduction of new legislation in the Canadian Citizenship & Immigration field? Regarding skilled workers, the government advises that new regulatory changes will be introduced sometime in 1995 with a view to implementation in the fall of 1995. It is anticipated that new selection criteria will emphasize an applicant's potential for long-term success, with a focus on education, experience, language skills in English and/or French, age and employability. Selection will no longer focus on an applicant's intended occupation. Measures will be introduced to expedite applications of immigrants who are needed to fill immediate labour market shortages. Regarding Business Immigrants, the government advises that regulatory changes should be in place in time for the fall of 1995 with implementation scheduled for 1996. It is anticipated that changes will focus on the potential economic contribution that business immigrants will bring to Canada. Changes are likely to provide for a greater emphasis on entrepreneurs and investors with a strong business background and the capacity to integrate into the Canadian business community. The government will establish basic criteria regarding the level of investment required. As well Provinces will be afforded some jurisdiction to add elements to suit local conditions. The Investor component of the Business Immigration program will be modified to emphasize regional development and providing risk capital to small and medium-sized businesses. A private sector panel is expected to provide recommendations in the spring of 1995. As of November 1, 1994, a moratorium will be placed on new investor fund offerings. Entrepreneurs will be encouraged to visit Canada as often as necessary before immigrating, in order to become familiar with local market conditions and to obtain the support of the Provinces in which they intend to establish their business. Once admitted as permanent residents, entrepreneurs will be expected to establish a business within and maintain it for a specified period of time of between 6 months and 2 years. As well, the standards for determining economic benefit will be made more objective with an increased role afforded to the provinces. Compliance mechanisms will be introduced to monitor and confirm job creation. In the area of Family Class immigrants, the government will attempt to implement its objective of maintaining a strong family class by introducing initiatives in five areas: 1) The sponsorship agreement will be redesigned to clarify the sponsor's obligations and to ensure that the Undertaking of Assistance is more readily enforceable; 2) A more realistic financial assessment of the sponsor will be developed in consultation with provinces and other interested parties; 3) Sponsorship obligations will be better explained both at the time the Undertaking is signed and when it appears that the sponsorship has broken down; 4) Discussions with non-governmental organizations, the public, provinces and financial institutions will begin on the possible introduction of a financial guarantee or "sponsorship bond"; 5) The government will work with provinces and municipalities to improve the enforcement of sponsorship agreements through better information exchange and the development of efficient and effective enforcement procedures. As well parents and grandparents will be established as a separate immigration category. Temporary Worker Authorizations Regulatory changes will be implemented in 1996. The processing of temporary workers will be streamlined to ensure timely responses to short-term employer needs. Citizenship The government is currently preparing legislation towards the implementation of a New Citizenship Act. This commitment stems in part from the findings of the Standing Committee on Citizenship and Immigration which were submitted to the Minister in June 1994. The most significant change to the citizenship process is the planned elimination of citizenship judges and the proposed implementation of a new administrative process. Can the Government implement changes to its current selection process prior to the enactment of its proposed legislation? Indeed, there are a number of mechanisms within the structure of the Canadian Immigration Act and its attendant Regulations, which are policy oriented and which can directly affect the assessment process of prospective immigrants to Canada. For example under the Independent category, certain factors enumerated within Schedule I of the Regulations, such as Factor 4 - "Occupational Demand" and Factor 6 - "Demographic Factor", can entail a modification of the units of assessment allotted, without regulatory enactment. This frequently occurs in the form of modifications to the General Occupations List and/or the Designated Occupations List. However, in view of the sweeping nature of the proposed modifications to Canada's current legislative framework in the Citizenship & Immigration field, it appears unlikely that the Government will introduce any significant changes to the current selection process in the immediate future. +--------------------------------------------------------------------------+ 2.
