More than 50 people attended the seminar. Mr. HUANG Zijian, Ex-President of CSSA-Alberta and FCSSC representative to China projects, reported the current situation of Chinese students and scholars in Canada, introduced FCSSC and reviewed the development of FCSSC in details to the audience. TAN Min, Secretary General of CAA, chaired the seminar, and Ms. CHEN Yao, VSI Chief Representative to Beijing, introduced the Canadian immigration policies and application procedures after Mr. Huang's speech. At the end of the seminar,Tan and Huang also exchanged views and reached same opinions on how FCSSC and CAA cooperate in the near future. +--------------------------------------------------------------------------+ 2. Changes To Canadian Immigration Regulations +--------------------------------------------------------------------------+ Forwarded By: Zhu Ningsheng Date: Nov. 24, 1995 CHANGES TO CANADIAN IMMIGRATION REGULATIONS By Millie Hrnjez, B.A., LL.B. On November 17, 1995, the Minister of Citizenship and Immigration announced proposed changes to Regulations dealing with immigration of workers to Canada. These Regulations will come into effect on February 8, 1996. The proposed changes do not affect family class sponsorship or business class applicants. Many of our readers have at least some familiarity with the current Immigration criteria for independent applicants. The proposed changes will dramatically alter the criteria. The following is a brief description of the new factors. Point System Although the point system is still in effect, it has changed in that the maximum points that an applicant could possibly obtain is now 74. As well, the number of points that an applicant must get changes according to the work category involved. The categories are: Professional - 52 points Skilled Administrative - 52 Technical - 47 Trades - 45 Education Points will be awarded for completion of secondary school and above. However, points will also be awarded for trade certification or apprenticeship program. The maximum number of points available is 15. Work Experience As before, an applicant requires requires at least one year experience in the chosen occupation, and under the new rules, this experience must have been obtained within the previous five years. The maximum points awarded for experience is 6, and the applicant must have at least five years of experience to get the maximum. One year of experience is awarded one point. Age Several changes have been introduced to this particular category. Applicants who are between 25 to 35 years of age are awarded the maximum number of 9 points. Applicants who are 24 years old or between 36 and 39 years, obtain 8 points. The points decrease as the gap increases from the target age group. Applicants 19 or 45 years old receive 2 points, and 0 points if younger than 19 or older than 45. Knowledge of English or French Ability in one of Canada's official languages will become even more important under the proposed Regulations, because statistics show that permanent residents who have language skills when they arrive in Canada are more likely to successfully establish themselves. The total points available is 15, with a maximum of 12 points for fluency in one of either English or French. The points awarded for fluency in one of the official languages is also a significantly greater percentage of the total maximum points available. Adaptability This heading replaces what was formerly known as "Personal Suitability" and is worth a maximum of 12 points. There will objective guidelines, not yet available, provided to assist the visa officer in assessing an applicant's adaptability to the Canadian labor market. Labor Market Balance The maximum points available is 10. The points allotted to each of the four skilled worker categories will be set by Regulation and may be different for each of the occupational categories depending on the types of workers the Canadian market requires. Arranged Employment The points available for arranged employment has decreased from 10 to 3. However, a number of occupations will require applicants to have arranged employment in Canada in order to be considered. Arranged employment is not just a job offer, but a job offer that has been approved by the National Employment Service. Relatives in Canada Four points will be awarded to an applicant if he or she has a brother, sister, aunt, uncle, mother, father, niece, nephew, or grandparent, who is at least 19 years old, and is a permanent resident or citizen of Canada residing in this country. The Open Occupation List, points for intended occupation, and points previously awarded for Specific Vocational Preparation will no longer apply. Instead of the Occupation List, the new Regulations divide the skilled worker program into four occupational categories. Certain less skilled occupations are not available, but all occupations in these four skilled categories (professional, skilled administrative, technical, and skilled trades) are available. Applicants must show that they are able to perform the duties of an occupation in one of these four categories in order to be considered under the skilled worker program. Of course, as stated above, some occupations will require arranged employment in Canada. This overview is meant to inform our readers about the proposed changes in Immigration Regulations.
