We understand that this bill, if enacted, will effect a number of radical changes to this country's immigration policy, including a drastic cut on the number of aliens of extraordinary ability, such as outstanding scientists, experienced professionals and skilled workers, to be granted permanent residency. While immigration does pose some real challenges that must be addressed, we believe that the changes proposed in H. R. 1915 work against the fundamental interests of this country, whose current status as the world's only superpower is integrally associated with the work of the immigrants. We must not forget that it is with the minds of the world's best and brightest that this country has become the richest and most powerful in the world. From Albert Einstein to the engineers in Silicon Valley to the Asian investors, immigrants have combined their knowledge and experience with those of Native-born Americans to build this country into a diverse and yet harmonious society, one that serves as a shining example of compassion and prosperity for other countries. It is hard to imagine what kind of USA we would have today, or indeed whether there would have been a USA at all, without the immigrants. Likewise, we cannot imagine how this country will benefit by cutting back on its intake of immigrants who can make the most contributions. By denying the American dream to those who can best fulful it, this bill goes a long way to endanger the American dream itself. In view of the tremendous negative impact such changes will have on this country and with the country's best long-term interests in mind, we urge you, in the strongest terms, to vote against this bill. CHANGE IN EMPLOYMENT-BASED CLASSIFICATION. Section 203(b) (8 U.S.C. 1153(b)) is amended by striking paragraphs (1) through (5) and inserting the following: `(1) Aliens with extraordinary ability. Visas shall first be made available in a number not to exceed 15,000 of such worldwide level to immigrants `(A) who have extraordinary ability in the sciences, arts, education, business, or athletics which has been demonstrated by sustained national or international acclaim and whose achievements have been recognized in the field through sufficient documentation, `(B) who seek to be admitted the United States to continue work in the area of extraordinary ability, and `(C) the admission of whom into the United States will substantially benefit prospectively the United States. `(2) Aliens who are members of the professions holding advanced degrees or aliens of exceptional ability. `(A) In general. Visas shall be made available, in a number not to exceed 60,000 of such worldwide level, plus any visas not required for the class specified in paragraph (1), to immigrants who are aliens described in any of the subparagraphs `(B) or `(C). `(B) Aliens who are members of the professions holding advanced degrees or aliens of exceptional ability. `(i) In general. An alien is described in this subparagraph if the alien is a member of the professions holding advanced degrees or their equivalent or who because of exceptional ability in the sciences, arts, or business, will substantially benefit prospectively the national economy, cultural or educational interests, or welfare of the United States, and whose services in the sciences, arts, professions, or business are sought by an employer in the United States. `(ii) Determination of exceptional ability. In determining under clause `(i) whether an immigrant has exceptional ability, the possession of a degree, diploma, certificate, or similar award from a college, university, school, or other institution of learning or a license to practice or certification for a particular profession or occupation shall not by itself be considered sufficient evidence of such exceptional ability. `(iii) Labor certification required in certain cases. An immigrant visa may not be issued to an immigrant under this subparagraph until the consular officer is in receipt of a determination made by the Secretary of Labor pursuant to the provisions of section 212(a)(5)(A). `(C) Certain multinational executives and managers.
