Call Senate Now to Save Employment-Based Immigration! ................ 46 Anne Frank, Staff Reporter As we have reported long before (see COINR9520, September 25), Senator Alan Simpson has finalized his anti-immigration bill and introduced his bill, now designated as S 1394, to the Senate's Subcommittee, and vowed to get its mark-up completed within one week by November 13th, before ANY oppositions can have a chance to fight against his evil-spirited brainchild! Now it is too familiar to us, since Rep. Lamar Smith had played the very same trick back in late July, when Rep. Smith had wished to sneak his 300 pages H.R.1915 through House's Subcommittee in one week with terrible cuts to legal immigration provisions nested deeply in his seemingly harmless bill; but has failed miserably. Our pro-immigration coalition fought back quickly and decisively - the whole mark-up process for the H.R.1915/2202 took a whole log of three month to complete instead of one week, and there is no chance for that bill, H.R.2202, to go through through the Floor in this year! Now, the fate of S 1394 and immigration are at our hands. Can we fight back to stop this scapegoating nonsense by flashing the Senator's switchboard with thousands of angry phone calls? Remember, every phone call counts, you do not need to be a U.S. citizen, you do not have to have a greedcard, your immigration status is NOT important but your opinion and your phone calls - you can make as many phone calls as you want, all of them count! Senator Alan Simpson and his supporters need to know how unpopular his bill is, our friends in Congress need to know how many constituents are on their side, our coalition needs this precious time to gather our forces and gain more ground to fight back - all of those depend on your phone calls! Please pick up the phone and dial the Congress before it is too late! If anyone thinks the H.R. 2202 was not that bad after all, IT WAS BECAUSE we joined force and fought back vigorously in last several months. We had made a difference to the H.R. 2202. We should make more to S 1394, and we will! What does S 1394 do to hurt Employment-Based Immigration? ............ 38 _From: hq@ifcss.org 1). Worldwide employment-based preference is reduced to 90,000 from current 140,000; 2). Labor Certificate (L.C.) becomes very difficult to obtain because employer must pay 25% fee (value of the annual compensation inclu- ding wages, benefits, and all other compensation) for each appli- cation; 3). Maximal stay for Non-immigrant H-1B and L visas is reduced to 3 years (current 6 yrs for H-1B and 5/7 for L); 4). New fee is imposed on employers who want to employ H-1B applicant which makes employer very difficult to hire aliens. The fee would be 5% first year, 7.5% second year, and 10% last year of stay ( fee = annual compensation including wages, benefits and all other compensation); 5). Additional attestations are required before approval of H-1B: a. must pay H-1B worker at least 100% of the actual compensation paid by the employer or 105% of the prevailing wage level; b. no displacement of U.S. workers (must pay H-1B replacement workers 105% of the mean of the compensation paid the laid-off US worker; 6). H-1B worker must have 2 years experience outside the U.S.in their specialty occupation after obtaining the most recently received degree (it means everyone must leave the U.S. for 2 years before coming back for applying H-1B) 7). Asian Students Union at UC Berkeley Are In Action .................... _From: Oliver Wang I received this update today from a contact of mine who works in the Department of Justice, Office of Legal Affairs, in Washington D.C. It concerns proposed restrictions on the hiring of foreign students upon graduating from college: Also, on the immigration bill now pending in the Senate--there is a provision which will cut off immediate employment opportunities for graduating foreign students. It works like this: In order to get a work visa, you have to have 2 (or more) years of experience in that profession in a foreign country. So, a graduating student in the sciences would have to go elsewhere 2 years before getting authority to work in the U.S. This is designed to eliminate competition for U.S. citizen graduating students. On the other hand, it's another message of Don't come. Do you have a reaction as to where APA students would come down on this? ------------------------------------------------------------------ Things are going strong here at UC Berkeley. We've continued to send information out over email, and members of ASU (Asian Students Union) have been collecting signatures on form letters to send to Congress. Hopefully people are continuing to write or fax their legislators. If you need the names and numbers again, email me and let me know. Some of the speakers who will be there include: Nancy Coolidge from the UC Office of the President, Richard Black, Director of Financial Aid, and somebody from the Asian Law Caucus.
