Someone hit my car when he pulled out from a parking place. He was given 3 or 4 tickets for accident, no driving licence, no insurance, and for drinking (?). So everyone will know immediately that I have problem to collect money. Fortunately, my car is covered for collision with a deduction of $300. My insurance company will pay $900 and I need to pay $300 for the repair. The insurance company is trying to collect the money, but we think the chance is slim. The company says they cannot go to small court, but I could do that if I wish. My questions are: 1. should I try to sue that guy in small court? if yes, what should I do first, and how? 2. If insurance company fails to collect money from him, how big is the chance for me to go to small chance? [Response] It's nice to know you insured yourself from uninsuranced vehicle and have a $300 deductible. Many people either don't have this kind of insurance or have a $500 deductible. If you know you will have a tough time to collect your money, then forget about it. If you have read recent issues of JCS, you should know there are people who go to lots of trouble to win their cases only to realize that the judgment is uncollectible. Your insurance company will have a collective agency to collect the money for them. The reason they are not willing to go to court is they know they won't be able to get the money if they win. Another reason is it costs an insurance attorney much more money to go to court then an individual like you. - Dan Wu ______________ [Question #3] Traveler's Visa For Parents I like to have my parents visiting here for graduation ceremony. However by the time of ceremony, I will probably have graduated, and be working as practical training. Does anybody know if my parents can apply traveler visa to visit me? [Response] Yes, It is possible for your parents to visit you during your practical training stage. However, there is no guarantee that US Consulates in China will approve it. You probably need sending following documents to your parents to help them to get B-2 visitor visa. 1) an invitation letter from you to your parent; 2) a letter from the Office of International Student Advisors at you University to explain your current status; 3) A bank statement of balance with reasonable amount of money which can cover the expenses of your parents' visit. - Zhi Xu Is I-134 form needed? Things vary from case to case. If you hold a student visa, for example, J-1 or F-1, I-134 is not necessary if you have financial resources such as assistantship or postdoctoral fellowship. However, if you financial support is very questionable, you will probably be asked to have I-134 form ready. - Zhi Xu ______________ [Question #4] How to Fax Chinese through Modem I'm a user of Quick Link Fax2 (QLFAX2), a program that enables me to send fax messages through a modem built in the computer. Although I can fax and receive messages in English, and receive fax messages in Chinese, I cannot fax out messages in Chinese (what is received are strange symbols). My Chinese word processor is Xia Li Ba Ren. I was told that I might try to save my document in Chinese as graphics or ascii, but Xi Li Ba Ren does not give me that option (i.e. I don't know how to save like that). I would appreciate it very much if anyone could tell me how I can fax Chinese documents using QLFAX2 or Winfax. Please send response to ho@newschool.edu. [Response] Generally speaking, Chinese word processor is Graphic Interface. That means each Chinese character is a small picture. So before a program specifically designed to control a Fax modem for Chinese character comes out, it is better to save or capture screen into a graphic file (I don't think it is possible to save it as ascii file unless decode it). Then it can be faxed by means of other program. I don't know software Xi Li Ba Ren (I guess Xia Li Ba Ren ?). If it is Xia Li Bs Ren, it must be in GB format. You can use NJSTAR to open the file, then output it as PCX file. You can use plenty of softwares such as Paintbrush in Windows to open PCX file and transfer to other format if specific format is required to send graphics through you modem. Another way to change Chinese file into common format graphic file without changing Chinese word processor is to use screen capture. SCREEN Thief (ST) is one of the screen captures. You may get it through Ftp site: . Run screen capture first, then run your word processor to show the file on screen, finally press a combination of keys to capture the screen into a graphic file. Now what you have to do is to send a picture through modem. You may check with the document coming with WinFax for how to send picture. - Liqun Liang [2] Liqun has responsed this question. I just want to add one point. There are a number of Chinese word processes which support PRINT command in MS Windows. Generally speaking, all of these Chinese word processors can be used to send fax through a modem by simply selecting the modem as the PRINTER as long as a fax-sending program installed under Windows, such as WinFax. However, different Chinese word processes may behave differently. I have ever tried YIHAO, DINGDANG and TWBRIDGE. YIHAO is basically a Chinese reader which supports PRINT command and both GB and BIG5 code. It sends very good fax using 16X16 Chinese fonts. I have not got any problems so far using YIHAO to send fax. DINGDANG is a Chinese word processor which supports PINYIN and CANGJIE input method (shareware version). It also send fax but sometimes causes problem if there are English letters inside a Chinese article. This problem also occurs in printing. TWBRIDGE is a Chinese shell running above MS Windows. Under TWBRIDGE people suppose to be able to run most of the Windows programs in a Chinese mode. This program also supports PRINT. Using the method above, you don't have to convert your Chinese file into a graphic file and then open a graphic program to send it. The only thing you need to do is to load your Chinese file into one of the processors and select the port (either a serial or parallel) in which your modem is set as the printer port and PRINT. If you use WinFax, you always can check the send-log to see what your fax looks like. If you are not satisfied with the appearance of your fax, try another Chinese word processor. All of the word processors I talked about can be found in ifcss.org and cnd.org. There are lots of Chinese programs in the two ftp sites, you may try several and find one you like and keep it. Don't forget to register if it is shareware. - Guang Hong ______________ [Question #5] Can F1 Holder Be Self-employed Is it legal for a F1 holder do some self-employ based business during his stay in the United States? Is it possible? If so, under what kind of circumstance? [Response] I don't think that it is legal for you to work as F-1 holder, whether you are employed by someone or by youself. F-1 is student visa for study only. If you need to work, you have to get work permit from INS, and then you can work either for someone else or for youself. - Shuai Ding ______________ [Question #6] How to Start My Own Business Hi. I am a new Chinese student. My friend has the interest to set up a coorperated company here. He now lives in China. Do you have any information on how to do it? What's the reasonable cost? We also plan that after we set up a company here we will have a branch in China as a foreign company. That means what we want now is to have a company title here and start a company business in China. What information should I know? [Response] As per your question that you and your friend would like to start an "American" business, then setup an office in China. The following response is of some basic information. I suggest you find more information in your business school library or look up "Dept of Corp., Secretary of State" under the category of " Government Agency" in your local phonebook and visit their office for details. There are three major legal forms of business enterprises: (1) A sole proprietorship is an individual in business for himself or herself. It is very to organize; the proprietor is his or her own boss and has substantial freedom of action. Disadvantages of this type of business include financial restrictions on firm growth, the inability to specialize in management, and the fact that all of a proprietor's assets are potentially available to creditors. (2) The partnership is that two or more people agree to own and operate a business. They pool the financial resources and share the risks and the profits. Easy to organize; Disadvantages include the finances of partnerships are still limited; the continuity of a partnership is very precarious; each partner is liable for all business debts incurred. A wealthy partner risks money on the prudence of less affluent partners. (3) Corporations are legal entities, distinct and separate from the individuals who own them. Corporations have easier access to bank credit; and have the distinct advantage of limited liability. The owners (stockholders) of a corporation risk only what they paid for the stock purchased. Their personal assets are not at stake if the corporation founders on the rocks of bankruptcy. Creditors can use the corporation as a legal person. Usually you may register a sole proprietorship or partnership at business license office of local city hall, expenses are less than a hundred dollars. To register a corporation at the Secretary of State costs from $600 to over $1000. You also need to file ficticious name (at local county government) so that your corporation's name will not be repeatedly registered by others. Since each state has different agency or offices in charge of business matter, you may need local help. - Brian Su [More Question] This case might involve some immigrant problems. What should the company do for my friend to get L visa ( I suppose that is the right type of visa)? [Response] As I understand that you and your friend have no any idea about what you are going to do. Anyway, I 'll make my response shorter this time. If your friend wants to immigrate to the U.S. by setting up business in the states. He does need get L-1 visa. But first of all, he must have a legal and well-performed corporation in China. Then he can come to the states to register a new business as a branch of his Chinese firm. As I know, it is easier for L-1 holders to obtain permenant residency after two years of the well performance of the corporation. The corporation can apply, on behalf of the L-1 holders, for PR status for their L-1 employees. Questions Seeking Advice ---------------------------------------------------------------------------- [Question #1] CSPA and Later Arrival Dependents Dear IFCSS HQ officials, The INS at Wisconsin state is starting to interview the LADs of CSPA beneficiaries. There is a question about the LADs of CSPA beneficiaries raised by our local members: Do LADs, who were under 21 years old while they were filing PR application forms but will be over 21 on the date of INS interview, still qualify for PR adjustment? Since some of LADs noticed from CND (issued in the end of last December or the beginning of January) that there was a meeting between IFCSS officials and officials of US Department of Justice, in which IFCSS requested that those LAD children who had not yet been over 21 years old when they send their PR adjustment petition in last Augest or September should be covered by CSPA followiag PR adjustment project, we wish you could provide more information about. Please let us know if there was such kind meeting? What happened about that request since then? What we should do to help those over-age LADs? As we know, in some other states, the LAD interview was started in last November or even earlier. There the older LAD children got covered, or got much less trouble than in Wisconsin. Is IFCSS going to keep helping the over-age LADs? Chinese Independent Union (CIU) at UW-Madison (4/10/94) (Draft by Robert Chen, vice-resident of CIU) _______________ [Question #2] SS-Tax for J-1 Scholar Hi, I have a question about the social security tax (SS-tax) for J-1 scholar. I have been in the states for little bit more than 2 years and I am still willing to file 1040NR form for part of of this year (i.e., time before 3-year period). But I has been asked to pay SS-tax for this year. My University told me that it is because I have been here for 2 years and thus should be considered as residence (for tax purpose). I know this is different form the related regulation stated in Publication 519. But they said there is a new regulation in 1992 regarding this issue. Is it true? I would appreciate your answer. I think many J-1 scholar have this problem. Thanks! Is it possible for someone with only a bachelor's degree to apply H-1B? If I'm on H-1 visa, is it difficult for my parents back in China to get visitor's visa from the U.S. Embassy? Where can I find answers to above questions? Will they be sent to me or posted somewhere? [Note: You may find partial by reading the back issues of JCS.] _______________ [Question #4] Category Switching Under J-1 I learned that it is now possible to switch between categories under J-1 and this is a change made about a year ago(new regulation for J-1). Is there anybody which is familiar with this matter? My question: where can one get a more detailed description of the changes? Has anybody applied for such a switch? What are the reasons for switch? Who will be the sponser(current sponsor or new sponsor)? How much percent of application is approved? Can an immigration lawyer help in such cases? And I just got married to an American citizen. Now I have some question about our tax. 1. After I get PR status, will my tax payer status change? Now I am paying the tax as a foreign student and chinese citizen. By the time I change my status, can I still apply tax treaty deduction? 2. If I still can apply tax treaty, how can we fill tax return since he was borned here? Will it make difference from those who got PR after they came to USA? 3. Which way will be better for us to fill tax return, separate or join? 4. Since I'm student and hold F-1 visa, I don't pay social security tax. But after I get PR status, do I have to pay that? Now, I have a question concerning my situation: I will be postdoc at a US national laboratory starting next month. Currently, I am enrolled in IFCSS medical insurance program. And I like the program a lot and was planning to continue my premium as well as adding my family to the program after I finish up my school and become a postdoc at the national lab. So last week or so, I picked up my phone and called the toll free ph# of the program to check it out to see if I can do so as mentioned above. At the other end, a Chinese- spoken lady told me I'll no longer be eligible after I leave the school I am currently attending and enter the national lab. Today, after I read the materials in your consultation service, in particular, the eligibility for the IFCSS medical insurance program, I mean I read it very carefully, I am not quite sure if the lady gave me correct anwser when I called the other day.
