My Colleages in Council:

This is to report to you the implementation of the Council Resolution on 
Workshops on 6da on my side. Mr. Ignitus Ding will attend 6da on behalf 
of Silicon Vally for Democracy in China. Originally, he was unable to go. 
He will speak on 6da openning ceremony and conduct workshops with one of 
his colleages Mr. Yu-tai Chia. I have done almost all liasion work and 
shifted the finalizing travel arrangement for they to Lin Changsheng and Shi 
Hepeing.

Also my arrangement for the workshop for small business development on 
6da had been completed earlier. The speaker is Ms. Sally Charles, 
Director of the Small Business Development Institute at the University 
System of Georgia.

The air ticket reservations for those guest except Mr Ding have been made 
by Changsheng and Heping. The formal invitation letters will be sent out 
soon from the HQ.

I agree we should not increase the reimbursement, at least now.
Right now, probably most part of our budget is going to be eat by
reimbursement.
We had made phone calls all day to contact travel agenents and airline
for possible group discount and cheap fair. Here is the cheapest one
we found (and they are very nice too).

[For example,  from LA to Chapel Hill, the deal she got for us is $390,
while others quote about $600.
It's even  cheaper than people booked one month in advance during the air
fare war.]

Subject:CNN Program Intermission

	As Chinse students and scholars have voiced concerned with the 
intermssion promotion for a CNN report on illegal immigrants, which is 
scheduled to broadcast in MoneyLine 7pm EDT today, July 19, 1994. It is said 
that the promotion has made a impression that the illegal immigrates from 
China has costs US economy $20 billion a year. I called the CNN MoneyLine 
program and the Programming. The following is the information I have got 
about the issue:

	I reached Mr. Andrew Deer at MoneyLine. I told him that I was 
calling in the capacity of a IFCSS Council Member and that some of IFCSS 
constituents have expressed great concerned of the way CNN has presented 
the story. I told him that, to my knowledge, the information presented in 
the promotion seems not true and misleading. I asked him to convey our 
concerns to his superior and correct the problem in the line of fact as 
soon as possible. He said the concern I had expressed would be addrressed as 
soon as possible. He said CNN would response my call.

	Then I reached Ms. Ann Feldman at Programming. She told me that 
Mr. Deer is the exact person I should talk to regarding the promotion. 
She also said that the promotion is made of the report and there is no 
intention with CNN to create such a impression. When I asked to stop the 
promotion, she said it was too late, because the program will be on the 
air in less than 45 minutes. But she said that she would pass our concern 
to appropriate persons.

	I have left my telephone numbers with them for further contact.

The SVC statement said "The opinion report released by the Finance

Then 15 lines late the statement said: "First of all, the financial 
operation of the IFCSS by the Headquarters lacks professionalism and has 
never been transparent enough to the general public."

Hey, what's going on here: an opinion report can be blamed not
reaching professiona standards and an official HQ operation can be excused 
only "lack of professionalism"?

I am wondering what is this SVC and what's SVC's standard here? Please, 
don't treat our mass CSS can be played and manipulated.

			A Response to SVC Statement

Dear Mr. Luo Lishi:

	Having just read SVC Statement on the appeals, I feel amazed
with the scope of subject matters it tries to deal with. Apparently, it
is no longer a judicial opinion on the cases brought to you; rather it
is a self-initiated evaluation of the roles played respectively by 
Inspection Team (IT), Finance Committee, Council, HQ, and many Council
members in the financial inspection. In this sense, I'd like to make 
some arguments to this document evidently prepared by you.

	Fair presentation in the accounting records is vital to the 
interests of the group members and those who donate. One of the treasurer's
duties in the case of IFCSS is to enter transactions and provide financial 
information fairly so that a true reflection is made in accordance with the 
GAAP (generally accepted accounting principles). What IT did in the past
months was exactly directed toward this objective. Irregularities in the
IFCSS's financial books were caused by the previous treasurer's unqualified
presentation, which seriously damaged the credibility and reputation of 
IFCSS.  This matter of such importance, however, is not even mentioned in
your quite comprehensive statement. In fact, IT had urged the treasurer many
times to make necessary corrections and adjustments so as to achieve the
balanced accounts and attract more contributions. All to no avail.

	Professional reports were not attempted until the previous
treasurer resigned and Jeff Lin, a CPA, stepped in. Like the treasurer of
IFCSS, none of the IT members has professional title. But IT has sufficient
working knowledge in the profession of accounting to issue its opinion
and is responsible for its spirit and letter. IT's comments and suggestions
were and are still valid. Whether they are negative or not is not the issue
in recognizing problems. IT's mission came to the end, at least in theory,
when Jeff Lin took over early this year. A comparison at glance would reveal
startling differences between the financial statements compiled by Jeff 
and the treasurer both in format and substance. I will make available the 
copies of the two statements to the public scrutiny when convenient.

	Jeff's participation undoubtedly pushed IFCSS toward standardization.
Nevertheless, his compilation of Income Statement and Balance Sheet has been
abused to dissolve the responsibilities to be borne by the treasurer. It must 
be made clear that Jeff's financial statements are at most a substitution to
rather than continuation from the treasurer's. Therefore, Jeff Lin's 
independent work is not equal to the assurance of no problem to the 
treasurer's performance. Nor should it be stretched to imply any assurance
to IFCSS's financial management. Remember what he says everytime he presents 
his reports, "I have not audited or reviewed the accompanying financial 
statements and, accordingly, do not express an opinion or any other form of
assurance on them." To attest assurance to any compilation, an auditor must 
be hired for examination. 

	My name and my work are mentioned in an unfavorable manner so 
frequently in the statement and so constantly over the entire course of 
action. I begin to feel personal stake in this matter and have to safeguard
my interest in any way I can. A few comments on SVC's capacity is as follows.
First, SVC is judicial and serves as a neutral arbitrator who stands above 
the dispute as a disinterested party to ensure that each side battles within 
the established rules. SVC is not prosecutor in such a way as being a part 
of the executive branch of IFCSS. Nor can it be prosecutor and judge at the 
same time. In the case of appeals, SVC's injunction should be limited to
the defendant--a person against whom an appeal is brought. A judgment beyond 
that such as the one on the IT's opinion and conduct is totally outside 
your jurisdiction. Second, SVC is designed to supervise IFCSS officials 
not volunteers. Subjecting volunteers to your judicial review is sheerly a 
ridicule and politically harmful to volunteerism.

	Recall what IT experienced in this adversary, certainly IT should 
have reacted to the pressure more out of patience than out of frustration;
IT should have been more prudent in wording and releasing public information;
and IT should have anticipated the unintended consequences. Besides, there
will be no regret, no apology, if that is expected. As for myself, I am
proud of and confident with what I did and wrote as a member of IT. You can 
challenge, but you will not gain.

	Finally, though SVC tried to be even handed in the statement, it 
must be realized that various disputes arise greatly from poor communication
and misunderstanding. SVC should learn how to mediate and reconcile them, 
rather than make "zero sum" decision, favoring one party at the expense of 
the other. Those involved in the disputes don't represent good or evil; they
represent different approaches and outlooks, and they all care about IFCSS.
If SVC is unable to unify, the least to do is to divide.

Hello, following only can be served as joke, nothing worth than that.


The so-called SVC statement said: "In summary, it is the opinion of the SVC
that the aforementioned isue need immediate solutions: first, the imperfection
in our system (the Constitutions, the Bylaws, and so on) needs to be mended;
second, the stability of the IFCSS' internation structures and the consistency
of the IFCSS' policies need to be drastically improved; and third, the 
operation of the IFCSS Headquarters needs to be professionalized to 
the commonly accepted standards."

So, based on above statement, no one did anything wrong, only the IFCSS 
system is wrong and IFCSS HQ need to be professionalized, right?  But, as 
quoated by my previous mail, SVC statement said IFCSS HQ only "lacks 
professionalism".

By the way,  dear SVC memebers, is your above OPINION up to professional 
standards?  Give us a clear answer, please!

Dear firends,

	It has been known for long time that the financial management is a 
problem in IFCSS HQ. Is it wrong to open such a messy situation to all CSS?
The function of SVC suppose to investigation important case and report to 
all IFCSS memebers promptly.  For such an important and big  issue inside 
IFCSS, the SVC now, only THREE DAYS before their term is over, to make 
such report to us.  What a lousy job they has been done?  Who are those 
SVC memebers?  Do they safeguard IFCSS correctly and properly?

	For those IFCSS 6da delegates, please open your eyes, donot vote 
those SVC members into office again for this kind of lousy job!! They 
provided no justice. Sad for IFCSS and SAD for CSS.

	My detailed comments on their lousy Statement on Appeals Relating 
to the IFCSS Financial Inspection will be sent in a separated mail.

	By the way, regardless of the length of the statement, the 
statement is not signed by anyone.  Is it an IFCSS' official document or 
just some personal communication and some illed person's dream?

	Dirty, oh, dirty.  I am wondering how long IFCSS can be last if these
dirty stuff keep poison IFCSS.

	The statement just released by so called SVC committee is an illegal
document.  Base on IFCSS bylaw,  SVC committee has no any position to evaluate
any IFCSS officials' work.  Only IFCSS 6da congress have the right to evaluate
any IFCSS officials performance therefore the delegates will decide whom 
should be voted.   The SVC's statement is just another allergation to those 
IFCSS activists.  I, as a Chinese student, make a public appealing to 
request IFCSS 6da congress investigate SVC's improper action and the 
consequences hereafter resulted from. I request Mr. Lou Li-SHi make a 
public explanation.

	On the night of July 18, 1994, 5 days before the openning of 
the 6th IFCSS National Congress, Mr Li-Shi Luo, Coordinator of the IFCSS 
Supervisory Committee, released a so-called Supervisory Committee's 
Statement on Appeals Relating to the IFCSS Financial Inspection. In 
his lengthy yet pointless statement, Mr. Lou plays a role of a 
prosecutor as well as a judge, makes blants accusitions against the IFCSS 
Council, Council Finance Committee and the work of the Financial 
Inspection Team (IT) and its members, distores the facts, complicates the 
gradually-improving situation of the IFCSS finance, provides the public 
with misinformation about the IFCSS financial issues. This Committee 
feels it imperative to issue this statement to keep the constituents of 
the IFCSS informed and to safeguard the interest of the IFCSS.

	The date of issue of the statement by Lou Li-Shi on IFCSS Financial 
Case in the name of the Supervisory Committe indicates that this action 
is premediated and full of unknown intentions. Nearly half year has passed 
since the IFCSS Working Conference in Wanshington, DC early this year, 
the SVC coordinated by Mr. Lou SIMPLY has do nothing to carry on his 
so-called investigations, at far as least half of the Council Members 
have been concerned. While accusing others not to take responsibilites, 
Mr. Lou himself seems not do his job at same time, either. Mr. Lou owes 
the IFCSS and the public an explanation for such causes.

	In his statement, Mr. Lou has played a dual-role of prosecutor 
and judge, a very unprofessional move. While accusing others of not to be 
professional enough, Mr. Lou simply ignores the basics of laws. He has 
gathered "evidences", and then handed down "verdits" on his own. While 
questioning the qualification of Mr. Bai Yan, a volunteer of the IT, Mr. 
Lou himself, with an advanced degree in psychics, which has nothing to 
do with a legal degree, attempts to exercise laws. Despite that he, as a SVC 
member, has been repeatedly advised by US lawers of not play a role of a 
judge given the Maryland Corporation Law, under which the IFCSS is 
registered as a non-profit orgization, Mr. Lou still dare not care the 
consequenses of unauthorized practicing of laws.

	In spite of undeniable fact that IT has found during its imcompleted 
inspection such as: the filing of IFCSS tax returns was over due, the 
slopiness of the HQ Treasurer, personal imcome tax invasion by the IFCSS 
HQ officers in the past years, and using public funds for personal use, to 
name just a few. And despite of the undisputable fact that, after the 
financial inspection and the hiring a professional accountant, the IFCSS 
has been fined by the Internal Revenue Service for failure to file a tax 
return in time, the IFCSS HQ officers of both former and current have 
paid or have to pay the personal imcome tax, and the accuracy down to 
cents in the report of the balance of the IFCSS accounts by the IFCSS 
President Mr. Lin Changsheng to the Council recently, Mr. Lou still tries 
to deny the work of the IT and the results of such an inspection. In 
stead of recognizing the positive results of the paintaking effort by the 
IT and Council, Mr. Lou has made widespread groundless allegations 
against all the IT members, all active Council members involved in the 
process, and those volunteers, under the current IFCSS Consititution, 
By-laws, and Regulations. To Mr. Lou, it seems wrong to implement the 
Council resolution and breaking "rules" to tackle the financial problem 
which had accumalated for years, while paying lip services is in a 
position of judging those who work hard. What a mentality! What a 
logic!

	While accusing other of breaking rules, lying and concealing facts,
Mr. Lou forgets mentioning a couple of facts involved. First is that, during 
the 2nd Council Teleconference in late Novermber last year, Mr. Lou, an 
observer, should not speak until asked to do so, jumped into the meeting 
and made uninvited and illegimate questioning of a participant. His words 
and action threw the whole meeting into chaos, interruptin the mormal 
proceeding of the meeeting, and made it all most impossible to continue 
the conference. Mr. Lou's exellent demonstration of how he violated a set 
of the well-written Council Teleconference rules has been well documented 
in the recording of the meeting ( A copy of the audio tape is available 
from the Council Secretary Mr. Chen Dong for a nominal charge). 
Second is the fact that his false statement on contact by his and other 
SVC members with the Council Members. He claimed the contact was made 
"via telephone, e-mail and personal contact". For one example, however, 
during the Washington Working Conference in Febuary, Mr. Lou could spare 
himself to invite one of IT members, who was a roommte of Mr. Zhou 
Hongguang, the Coordinator of the IT, to drink and chat rather than 
finding a time and bothering to talk to Mr. Zhou. This false statement on 
this matter by Mr. Lou alone has already constituted 
what he calls a perjury.

	Praising the dedicated IFCSS officers and selfless volunteers who 
should been credited for the achivements for IFCSS, Mr. Lou has lauched 
vicious attact on the IFCSS Council members, IT members, and especially 
unbrearable, on Mr. Bai Yan, a volunteer from Texas Tech University, who 
is to receive his PhD in Public Administration soon without any 
sustantial reason. His conflict and war with Ms. Shen Tong, the former 
Chair of the Finance Committee is a public secret. Any personal 
affection and hatred should not involved in work under any working 
ethics. However, Mr. Lou has turned his personal likes and dislikes
against any people who and anything that may happened to have connection 
with Ms. Shen. By denouncing Mr. Bai, a true hero and dedicated volunteer 
for IFCSS financial situation among the average CSS, how could Mr. Lou 
make IFCSS be supportted by CSS? How could he prove himself to be such 
nutual as a judge given he cannot seperate personal emotions and public 
services?

	It is a simple rationale. Pointing out a problem is not damaging 
but the problem itself is damgeing. People should not be blamed for 
unveil a problem. But the people who created the problem should be blamed 
for. It is unfortunate that Mr. lou has failed to recognize the 
importance and impact of IT' work, the standards set by the IT which has 
changed the IFCSS financial management for good. That is, if any HQ 
officers dare to challenge the laws by returning to the previous 
financial practice, he or she will subject to prosecutin of law of the 
land. This is not only the achievement of IT, but one of the major 
achievement of the 5th IFCSS Council. It is also a triumph for IFCSS and 
its constituents for years over financial management.
		
	Because of above sated reasons, the integerity, judgment and 
qualification of Mr. Lou as a SVC member have to be called in questioning. 
His statement regarding the IFCSS financial cases is invalid as his 
inconsistant behavoir. This Committee therefore recommemds the coming 
IFCSS Congress look into his case to maintain the seriousness of the 
IFCSS Consitituition, By-laws, regulations, and above all, the Maryland 
Corporation Law.
