My friend, Mr. Lu Lin was an accupuncturiest and herb doctor in Houston. He was arrested on June 14 this year and charged with delivery of controlled substance contained in two Chinese herbal remedy "Tung Shueh Pills" and "Meng Nan (Strong Man)". Dr. Lu came to the states in 1988 from Beijing. He was a professor in a medical school. The case starts with the following story. A year ago, a Vietnamese, Lee, who claimed himself as a student of University of Houston came to Mr. Lu's herb shop and ordered a substantial amount of "Tung Shueh Pills", and said that the drug is for his uncle who lives and practise Chinese Medicine in another state. Half year later, Lee came again and asked Mr. Lu whether he had "Meng Nan", a Chinese herbal remedy used for athletes. Mr. Lu said he did not have it, but he can order it from Calfornia for Lee. (Mr. Lu never ordered "Meng Nan" before since he never had the need of selling it.) Lee then asked him to order. Later on, it was discovered that "Meng Nan" contains steroid which is under Government control. On June 6, Lee came to Mr. Lu's shop again and ordered 6000 "Tung Shueh Pills" and 1000 "Meng Nan" for his uncle. On June 14, Lee with other Drug Enforcement Administration officers arrested Mr. Lu for illegally possessing and selling drugs that contain controlled substance. When DEA made the arrest, they also seized some other drugs in the shop. They said they MAY not be legal. The bond was set to $750,000 but Mr. Lu did not have that much money. He was in jail until June 24 when the bond was reduced to $100,000. He used his house for that amount. Mr. Lu was waiting for the trial. All the drugs he sold in his shop are ordered from an importing company in Calfornia. That importing company in Calfornia is under investigation but no arrest has been made, no any drug from that company has been seized. Mr. Lu has the licence to sell drugs. On June 14, Calfornia Health Department published 40 kinds of Chinese herbal remedies that are illegal to sell in USA. "Tung Shueh Pills " and "Meng Nan" are not among them. There were more than 10 other Chinese Herb shops in Houston area were also selling "Tung Shueh Pills" but no arrest was made. Now here are the questions. 1. "Tung Shueh Pill" and "Meng Nan" are not among the published list of Chinese herb that are illeagal to sell in the USA. They probably will be on the list in the near future. Is it leagal to arrest licensed sellers before the list is adjusted ? 2. A DEA officer disguised as a customer ordered a drug that he knew might be illegal. Mr. Lu did not have that drug but he just ordered for his customer. He was prosecuted for that. Is that legal for a government agency to do that for an ordinary citizen? 3. The drugs enter USA under normal procedure. The drugs that Mr. Lu sold are from within the States. Who has the higher responsibility for obtaining the drugs in the first place? USA custom, the importing company or Mr. LU ? Is it leagal to arrest Mr. Lu while the one who sells the drugs to Mr. Lu is still set free ? 4. Many other herb shop sold "Tung Shueh Pills" but DEA make a preferential arrest of Mr. Lu. Is that legal ? I wish IFCSS can post my letter in the network. I also wish to know if IFCSS or any other reader can provide some help in this case. If Mr. Lu did not committed any leagal crimes by selling the drugs, is he able to claim his finacial and psychlogical loss due to this case from the government ?
