Welp, in california at least, I dont think its just a matter of
whether you where speeding or not. If you where caught unjustly,
then there is no case against you and it will be dropped. For example,
I beleive "speed traps" are against the law in CA (but still occur anyway).
To get for a ticket to be able to "stick", if it was radar that
you where clocked with, the road must have been surveyed in the
last five years (and the speed must be set according to the speed
of the 85th percentile of drivers). Also the radar must have been
"calibrated" (whatever standard to "calibrate " against -- i dont know).
If you where pulled over and the cop says that you where clocked by
aircraft, you can bring it to court and say that you where unjustly
given a ticket because of a "speedtrap". Most cops will ssay that
an airplane warnded them of you and then they "poaced you" for a couple biles.
Buti if you drive in your rear view mirror, like i do, you will know
if you are bieng paced.
My point: most cops give you a ticket when they think you are speedingh (and
you probably are). Most cops know that half the tickets they give will
be dismissed if challenged. But, they also know that very little of the
people given tickets will challenge their tickets. Know the law. Tell
the cop that is giving you the ticket that you know the sections etc etc
of the law and they will be less likly to pull a fast one on you. Then,
always fight the ticket and bring up the sections of the law that you
feel make your ticket unjust and the judge will probably dissmiss the
ticket in the interest of justice. (whether you where speeding or
not is not the issue).
