Jesus in Matt. 5:31-32 states:
. . KAI hOS EAN APOLELUMENHN GAMHSHi, MOIXATAI.
I suspect that this would apply to Herod.
Furthermore in all three synoptic accounts of the death of John the Baptist
(Mk 6:14f, Matt 14:1f, Lk 9:7f) hHRWiDIAS is called YUNAIKA TOU ADELFOU. I
don't have all the cultural details on this right at my finger tips but this
terminology seems to suggest that the divorce if there was one wasn't
recognized by John the Baptist and even if it were Jesus uses the term
MOIXATAI to describe such a marriage.
