
{"id":15660,"date":"2011-02-03T09:54:16","date_gmt":"2011-02-03T14:54:16","guid":{"rendered":"http:\/\/www.carrborocitizen.com\/main\/?p=15660"},"modified":"2011-02-03T12:22:04","modified_gmt":"2011-02-03T17:22:04","slug":"county-decides-against-sales-ordinance","status":"publish","type":"post","link":"https:\/\/www.ibiblio.org\/carrborocitizen\/main\/2011\/02\/03\/county-decides-against-sales-ordinance\/","title":{"rendered":"County decides against sales ordinance"},"content":{"rendered":"<p><strong>By Susan Dickson<br \/>\n<\/strong><em>Staff Writer<\/em><br \/>\nThe Orange County Board of Commissioners voted unanimously on Tuesday not to create an ordinance regulating door-to-door sales and solicitation in residential areas of the county, citing concerns with constitutionality and enforceability.<br \/>\nAfter county residents requested such an ordinance citing public-safety concerns, commissioners considered requiring a permit for door-to-door sales or solicitation, with an exemption for sales by members of charitable, religious, civic or fraternal organizations who receive no compensation; and sales by students under 18 for school activities. Sales of agricultural products would also have been exempted.<br \/>\nHowever, County Attorney John Roberts said an ordinance that exempted some nonprofits and not others could face issues of constitutionality.<br \/>\n\u00e2\u20ac\u0153If you\u00e2\u20ac\u2122re going to regulate one, you\u00e2\u20ac\u2122ve got to regulate them all,\u00e2\u20ac\u009d he said. Only two other counties in North Carolina Pasquatank and Catawba\u00c2\u00a0have ordinances regulating door-to-door sales.<br \/>\nCounty Manager Frank Clifton pointed out that including exemptions, such as for agricultural sales, could provide a loophole that other kinds of sellers could exploit.<br \/>\n\u00e2\u20ac\u0153It\u00e2\u20ac\u2122s one thing to pass a law \u00e2\u20ac\u201c it\u00e2\u20ac\u2122s another thing to pass a law that\u00e2\u20ac\u2122s enforceable,\u00e2\u20ac\u009d he said.<br \/>\nClifton encouraged concerned residents to put up \u00e2\u20ac\u0153No Soliciting\u00e2\u20ac\u009d or \u00e2\u20ac\u0153No Trespassing\u00e2\u20ac\u009d signs and to call 911 if they see suspicious individuals going door-to-door.<br \/>\n\u00e2\u20ac\u0153People who are up to criminal activity are not going to get a permit for criminal activity,\u00e2\u20ac\u009d he added.<br \/>\nCommissioners said collaboration between neighbors and law-enforcement officials was a better way to handle neighborhood security.<br \/>\n\u00e2\u20ac\u0153I don\u00e2\u20ac\u2122t\u00e2\u20ac\u2122 really feel like we need to move forward with this item.
