Electro Mechanical Systems (EMS) of Champaign, ILL, announced a ruling in its favor and the end of a patent infringement case brought by Carroll Touch, a subsidiary of AMP, against EMS. According to EPS spokespersons, in 1987, Carroll sued EMS, alleging infringrment of US Patent Number 4267443, which Carroll stated covered "beam averaging" for touch input devices. In Jan 1992, the US District Court in Danville ruled that no product of EMS infringed the the Carroll patent because none had beam surfaces spaced apart to allow determination of velocity, skew and other functions. The court also ruled the Carroll patent invalid as it did not beam average to a center point between light beams as claimed. In an opinion released on August 24, 1993, by the Court of Appeals, states Carroll failed to win a reversal of the noninfringement ruling or to win a ruling that its patent was valid.
