News brief: Death penalty hearing moved

A death penalty hearing scheduled for this week in the Joshua Bailey murder has been postponed until Feburary.

Six defendents are charged with first degree kidnapping and murder of Bailey. His body was discovered in early September off Big Woods Road in Chatham County. Autopsy results showed that he had been shot. Investigators have said Bailey was killed in a wooded area off Twisted Oak Drive in Orange County and his body later moved.

In an interview last week, Jim Woodall, district attorney for Orange and Chatham counties said the Rule 24 hearing, which is required if the death penalty will be considered in a case, would be delayed until February because the case is still in the discovery stage.

Woodall said he has not made a decision on whether to seek the death penalty and is waiting for the discovery phase to progress further.
