Executions halted–for now

AP:

Citing a law from 1909 that requires the governor and the council of state to approve any change in the execution process, Wake County Superior Court Judge Donald Stephens ordered Thursday the executions of Marcus Reymond Robinson and James Edward Thomas be halted until they do so.

“I believe this is a significant change in the execution protocol,” Stephens said. “In order to carry out an execution under these circumstances the governor and Council of State should review that protocol and approve it.”

Lawyer and Chapel Hill Town Council member Mark Kleinschmidt is doing an excellent job of keeping us up-to-date on the order halting executions in North Carolina.

I was caught off guard by Judge Stephens’ reliance on a little referenced NC statute that requires the Governor and the Council of State to approve execution protocols. The posture of the proceedings are similar to the recent moratorium imposed in Maryland when it was pointed out to a trial court there that the Maryland execution procedures had not been properly vetted through required public hearings and approved by the legislature.

There are still more than 14 hours before Marcus Robinson’s hertofore scheduled execution was to have taken place. Like any Superior Court Order this is appealable. I imagine Roy Cooper’s office (the Attorney General) is right now deciding whether they will pursue further review of Judge Stephens’ decision by the North Carolina Supreme Court. Should this go to the NC Supremes, my money is on Chief Justice Parker being the swing vote.

Gonna be a windy and will feel quite chilly. From the NWS:

COLD HIGH PRESSURE WILL BUILD OVER THE AREA THIS AFTERNOON. GUSTY WINDS AROUND 30 MPH WILL DEVELOP THIS AFTERNOON AND CONTINUE TONIGHT.
THE COMBINATION OF GUSTY WINDS AND TEMPERATURES IN THE LOW 20S WILL RESULT IN WIND CHILL VALUES AROUND 10 DEGREES MAINLY ACROSS THE NORTHERN PORTION OF CENTRAL NORTH CAROLINA LATE TONIGHT THROUGH EARLY FRIDAY MORNING. PEOPLE WHO MUST BE OUTDOORS LATE THURSDAY THROUGH FRIDAY MORNING SHOULD TAKE ACTION TO PROTECT THEMSELVES FROM THE LOW WIND CHILLS.

Hackney elected speaker

With 68 votes, Joe Hackney of Orange County has been elected Speaker of the North Carolina House of Representatives.
Once new members were all sworn in, by usage, custom and precedent, they voted in the Speaker.
Nominated by Verla Insko. “A true and loyal son of North Carolina.”
Seconded by Mickey Michaux. Spoke of “Joe’s compassion for the people of North Carolina.” He suggested Hackney run for governor sometime.
Also seconded by Joe Tolson.
He defeated Paul Stam. Nominated by Linda Johnson. Seconded by David Lewis.

Slow Food Hot Chocolate

Can’t think of anything that could help body and soul shake off a day like today than the above mentioned subjects.

And if you got time this afternoon to drop by the Century Center that’s exactly what you’ll get. The Slow Food Triangle folks, including a good number of local chefs and farmers, are reviewing their tour of Italy and the international Slow Food Conference in Torino. Sheila Neal of the Carrboro Farmers Market is the moderator.

In October, twenty-one of our local farmers, chefs, educators and agriculture professionals joined 6,000 delegates from 150 nations in Turin, Italy to work together to find solutions to the challenges they face as stewards of their land and communities at Slow Food International’s 2006 Terra Madre. Please join us on Sunday, January 21 from 4-6 pm at the Carrboro Century Center’s Century Hall to hear our Triangle delegates share their stories. For directions and information about parking. please visit their website.
Come sip bicerin (tasty Torino-style hot chocolate made with local milk from pasture-raised cows), see pictures from the trip and ask our panel of delegates about their experience.
